PROCEDURES FOLLOWED WHEN ISSUING SUBPOENAS
1. When a request is received to obtain records and only the medical facility's name is contained, FLSS will do
the following to attempt to locate the correct information. If FLSS is not successful in the location
of said documents, your office will be notified immediately.
-Operator assistance, phone directories, etc.
-Internet search for web pages
-Contact the American Medical Association, Medical Board, etc.
-Search through Cal. Doc. Finder
2. Issue Deposition Subpoena for Production of Business Records (J.C. form 982a152) setting the production date 30 days from receipt; Issue Notice to
Consumer (J.C. form 982a155).
3. Mail Notice to Consumer, Deposition Subpoena, Attachment 3 and Service List (pursuant to CCP 1985.3 and CCP 2025c) to Plaintiff's counsel on the day
issued.
4. Mail Deposition Subpoena and supporting documentation to every other party who has appeared in the action (pursuant to CCP 2025c).
5. Wait the required time (pursuant to CCP 1985.3 and CCP 1013) before serving all documentation and witness fees (pursuant to Evidence Code 1563) upon
the witness/facility.
6. Serve all documentation and witness fees upon the witness/facility giving the required time to comply (15 days pursuant to Evidence Code 1560)
7. Make all necessary follow-up calls to the facility to obtain a confirmation that the requested records are ready to copy.
8. Copy records on the production date or as soon as they are available.
9. Ship the requested records the day following copying to all counsel who has ordered.
